July 10, 2013 - The U.S. Court of Appeals for the Sixth Circuit overturned a lower court's grant of summary judgment in the trademark infringement dispute between 5-Hour Energy owner Innovation Ventures, LLC and Bhelliom Enterprise Corp., which produces "8-HR Energy."
The Sixth Circuit ruled that there is a factual dispute over whether Bhelliom's marketing for 8-HR Energy infringes Innovation Ventures' trademark for 5-Hour Energy. However, the Court stopped short of deciding whether Bhelliom infringes Innovation Ventures' trademark on "5-Hour Energy."
